ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No No BACKGROUND/JUSTIFICATION: Building #3 (Blu-Dot) is an industrial building constructed on Lot 2, Block 1 of Gateway North 4th with public utilities including watermain and shared sanitary sewer and storm sewer. The site also consisted of private parking lots, sanitary sewer services, and storm sewer. All public and private improvements have been completed including the final lift of pavement and final utility adjustments. An acceptable warranty period had passed and a final walk-thru with City staff was completed November 1, 2016. All items identified at this walk-thru have now been completed. Staff recommends accepting all public improvements associated with Lot 2, Block 1 Gateway North 4th Addition — Building #3 (Blu-Dot). Any remaining financial securities can now be released. BUDGET INFORMATION FUNDING: BUDGETED: ■ YES ■ NO RESOLUTION NO. 2017-11 CITY OF OTSEGO COUNTY OF WRIGHT, MINNESOTA RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS FOR LOT 2, BLOCK 1 GATEWAY NORTH 4TH ADDITION — BUILDING #3 WHEREAS, the City Council approved the final plat of Gateway North 4th Addition (the "plat"); and, WHEREAS, the City and Developer entered into a Developers Agreement September 25, 2014 for Lot 2, Block 1 Gateway North 4th Addition — Building #3 and recorded with Wright County regarding approval of the plat and installation of required public improvements within the plat; and, WHEREAS, all public improvements, including watermain, sanitary sewer, storm sewer, grading and erosion control have been completed; and, WHEREAS, all public improvements were constructed in accordance with City standards, Code and approved plans within the plat; and, WHEREAS, an acceptable warranty period has passed; and, WHEREAS, a final acceptance inspection of the public improvements within the plat was conducted on November 1, 2016 with City staff and the Developer, and all items identified at this walk-thru have now been completed. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF OTSEGO MINNESOTA THAT 1. The City accepts all public improvements lying within public easements and public right-of-way and these improvements shall be come City property.
