Staff recommends accepting all public improvements associated with Lot 3, Block 1 Gateway North 4th
Addition — Building #2 (Wagner).

BACKGROUND/JUSTIFICATION:
Building #2 (Wagner) is part of Gateway North 4th Addition, an industrial subdivision, with public utilities
including watermain and shared storm sewer. The site also consisted of private parking lots, sanitary
sewer services, and storm sewer. All public and private improvements have been completed including
the final lift of pavement and final utility adjustments. An acceptable warranty period had passed and a
final walk-thru with City staff was completed November 1, 2016. All items identified at this walk-thru
have now been completed.
Staff recommends that all public improvements be initially accepted and the warranty period be started
as of the initial acceptance walk-thru date of November 1, 2016. Per the Developer's agreement the
Developer warrants;
1. all public improvements, other than streets, within the plat against poor material and faulty
workmanship for a period of one (1) year after its completion and acceptance by the City.

CITY OF OTSEGO
COUNTY OF WRIGHT, MINNESOTA
RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS FOR
LOT 3, BLOCK 1 GATEWAY NORTH 4TH ADDITION — BUILDING #2
WHEREAS, the City Council approved the final plat of Gateway North 4th
Addition (the "plat"); and,
WHEREAS, the City and Developer entered into a Developers Agreement
February 29, 2016 for Lot 3, Block 1 Gateway North 4th Addition — Building #2 and
recorded with Wright County as Document No. T31382 regarding approval of the plat
and installation of required public improvements within the plat; and,
WHEREAS, all public improvements, including watermain, storm sewer, grading
and erosion control have been completed; and,
WHEREAS, all public improvements were constructed in accordance with City
standards, Code and approved plans within the plat; and,
WHEREAS, an initial acceptance inspection of the public improvements within
the plat was conducted on November 1, 2016 with City staff and the Developer, and all
remaining items have been successfully completed; and,
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF OTSEGO
MINNESOTA THAT
1. The City accepts all public improvements, other than streets, within the plat as of
November 1, 2016 thus commencing the one (1) year warranty period from this
date.
2. Upon conclusion of the respective warranty periods and completion of a final
acceptance inspection by City staff and satisfaction of any conditions of said final
inspection, improvements lying within public easements and public right-of-way
shall be come City property without further notice or action.
