07-53CITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA RESOLUTION NO. 2007-53 RESOLUTION ADOPTING ORDINANCE NO. 2007-09 AN ORDINANCE ANNEXING UNINCORPORATED LAND ABBUTTING THE EXISTING CITY LIMITS OF THE CITY OF OTSEGO, WRIGHT COUNTY, MINNESOTA PURSUANT TO MINNESOTA STATUTES 414, SUBDIVISION 2(3) PERMITTING ANNEXATION BY ORDINANCE WHEREAS, all of the property owners (Helfert, Shierts and Minnesota Native Landscapes, Inc.) of the Subject Property owning less than sixty acres and abutting the City of Otsego have requested annexation to the City; and WHEREAS, the land in question is deemed to be urban or suburban in character or about to become so; and WHEREAS, the City of Otsego has caused notice to be served in conformance with State statute and has held a public hearing on the matter on August 13, 2007 at a regularly scheduled City Council meeting; and WHEREAS, a commercial operation is proposed upon portions of the property and traffic from that operation would directly impact Otsego City roads; and WHEREAS, as a condition of annexation the owners of the proposed commercial operation have agreed to provide for upgrade of a portion of the the impacted road (77�' Street) to an agreed standard as approved by the City Engineer within three years of commencement of business operations; and WHEREAS, the proposed ordinance provides for City reimbursement to Monticello Township for taxable property annexed under the order pursuant to Minn. Stat. 414.036; and WHEREAS, the City has determined that the easterly parcel (Helfert Parcel) qualifies for differential taxation pursuant to Minn. Stat. 414.035. NOW THEREFORE, the City Council of the City of Otsego, Wright County, Minnesota hereby adopts Ordinance No. 2007-09 and hereby directs that the Ordinance be transmitted to State of Minnesota Department of Administration Boundary Adjustments for an order consistent with the ordinance.
