ITEM 3.2A 3.13.2017 MinutesITEM 3.2A OTSEGO CITY COUNCIL MEETING OTSEGO PRAIRIE CENTER MARCH 13, 2017 7:00 PM Call to Order. Mayor Stockamp called the meeting to order at 7:00 PM. Roll Call: Mayor Jessica Stockamp; Councilmembers: Vern Heidner, Jason Warehime, Corey Tanner and Tom Darkenwald. Staff: Adam Flaherty, Interim City Administrator/Finance Director; Daniel Licht, City Planner; Ron Wagner, City Engineer; Andy MacArthur, City Attorney; Kurt Neidermeier, Utility Manager and Tami Loff, City Clerk. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 1. Open Forum. Megan Jacobson, Brimeyer Fursman, distributed a report of the top fifteen candidates for the City Administrator search; these will be reviewed at the special meeting scheduled for March 20, 2017 at 6:00 PM. 2. Consider Agenda Approval. CM Heidner motioned to approve as written. Seconded by CM Tanner. All in favor. Motion carried. 3. Consent Agenda. (Non -controversial items). 3.1 Approve Claims List. 3.2 Approve City Council Meeting Minutes. A. February 27, 2017 Meeting. B. March 6, 2017 Special Meeting. C. March 7, 2017 Special Meeting. 3.3 Approve City Council Special Pay for February 2017. 3.4 Motion to Call Board of Appeal & Equalization Meeting on April 24 at 5:30 PM. 3.5 Motion to Call a Special Meeting on Monday, March 27 for Review of the WW Master Plan. 3.6 Approve Closure of Municipal Buildings Fund & Transfer of Remaining Funds. (Res 17-18) 3.7 Approve Highlands of Riverpointe Revised Final Plat and Development Agreement. CM Heidner motioned to approve. Seconded by CM Tanner. All in favor. Motion carried. 4. Public Hearing: 4.1 Imposition of charges within the Above Standard Streetlight Service District. A. City Clerk attests to Legal Notice. B. Presentation by Finance Director. C. Public Comments. D. Close the Public Hearing. E. Approve Resolution 2017-19. City Clerk Loff attested to all the proper noticing, posting and publication has been completed. Finance Director Flaherty presented the staff report. Mayor Stockamp opened Public Hearing at 7:05 PM. Hearing no public comments Mayor Stockamp closed the Public Hearing at 7:05 PM. 11 Page 3/13/17 ITEM 3.2A CM Darkenwald questioned a couple of properties that are not highlighted on the map provided in the packet. It was concluded it was a map error and that the exhibit does list those properties. City staff will update the map. CM Darkenwald motioned to approve Resolution 2017-19 Imposing charges for 2017 within the above standard street lighting special district. Seconded by CM Warehime. All in favor. Motion carried. 5. Community Development: 5.1 Sausser Addition: A. Zoning Map Amendment Rezoning from A-1 District to A-2 District. B. Conditional Use Permit for Subdivision of lots less than 20 acres within an A-2 District. C. Preliminary/Final Plat. City Planner Licht presented the staff report. Applicant Bill Sausser was present and had no additional comments. CM Heidner motioned to adopt Ordinance 2017-02 rezoning property included within the Sausser Addition to A-2 District and approving a conditional use permit and preliminary/final plat for three lots each with an area less than 20 acres within an A-2 District subject to the conditions included on the findings of facts dated March 8, 2017. Seconded by Mayor Stockamp. All in favor. Motion carried. 5.2 Shelauist: A. Zoning Map Amendment Rezoning from A-1 District to A-2 District. B. Conditional Use Permit for Subdivision of one lot less than 20 acres within an A-2 District. City Planner Licht presented the staff report. CM Heidner motioned to adopt Ordinance 2017-03 rezoning property included to A-2 District and approve a conditional use permit to allow subdivision of one lot with an area less than 20 acres within an A-2 District subject to the conditions included within the findings of fact dated March 8, 2017. Seconded by Mayor Stockamp. All in favor. Motion carried. 5.3 Amend the 2012 Comprehensive Plan Future Land Use and Transportation Plan Maps to Guide Additional Area East of TH 101 and South of CSAH 38 for Industrial Land Uses. (Resolution 2017-20) City Planner Licht presented the staff report. He stated the City Council has stated a need to identify areas for possible future industrial uses to allow for continued development particularly along the TH 101 corridor. City staff proposes 320 acres east of Queens Avenue be guided for industrial use. He stated this change would not affect anyone's current use of their property only future development. Mayor said 65th is a dirt road how would this effect that. City Planner Licht said essentially 65th Street would have to be upgraded; so if any of those property owners along there initiate development they would have to upgrade the road as part of the project. Mayor Stockamp asked if all the property owners in the shaded area were notified. City Planner Licht said no this is a general plan amendment so we only are required to publish notice in the paper that's the practice the city does for any amendments to the land use plan. It was discussed rezoning only a half mile east of Queens Avenue and include the property on the north side of the two forty parcels as at this time. 21 Page 3/13/17 ITEM 3.2A CM Heidner motioned to adopt Resolution 2017-20 amending the Comprehensive Plan Future Land Use Plan and Transportation Plan for future industrials uses as discussed with rezoning only a half mile east of Queens Avenue and include the property on the north side of the two forty parcels as at this time. Seconded by CM Darkenwald. All in favor. Motion carried. 6. Utilities: 6.1 Water Tower Logo. This is a follow up from the last meeting. Utility Manager Neidermeier presented city logo options for the water tower. The City Council concurred to set logo directly on CSAH 38 east and west with a non bolded logo. There was discussion on if possible slightly shifting the east side logo. Construction will be in April and completed July 3rd weather permitted. 7. Legal: 7.1 Consider Data Practices Policy. City Attorney MacArthur presented the staff report. CM Heidner motioned to approve Resolutions 2017-21 adopting the City of Otsego Data Practices Policy. Seconded by CM Warehime. All in favor. Motion carried. 8. Public Works: improvements for Quam Avenue ana ec•" Street. City Engineer Wagner presented the staff report stating the proposed improvements are necessary, cost effective and feasible from a technical and engineering stand -point, and benefit the properties proposed as shown. CM Warehime asked if this would be built to commercial standards. City Engineer Wagner said no and further stated there is no commercial to the north only residential. CM Warehime motioned to approve Resolution 2017-23 Receiving Feasibility Report regarding the Street Improvements of Quam Avenue (St. Michael border north to 62nd Street) and 62nd Street (Quam Avenue east to the cul-de-sac) and calling a Public Hearing for residents to be presented project scope, estimated project costs and possible assessments. Seconded by Mayor Stockamp. All in favor. Motion carried. 9. Administration: 9 1 Call Special Meetings on March 31 and April 1 2017 for City Administrator Interviews. CM Darkenwald motioned to call special meetings for the City Administrator Interviews on Friday, March 31, 2017 at 2:30 PM to be held at Prairie Center and Saturday, April 1, 2017 at 7:30 AM to be held at City Hall. Seconded by Mayor Stockamp. All in favor. Motion carried. 10. City Council Reports and Updates. No items. 11. Staff Reports and Updates. Interim City Administrator/Finance Director Flaherty gave an update from Wright County on the concept of establishing a Countywide sales tax to help pay for County road improvement projects. A map and list of projects from the County was reviewed at this time as well. He also gave a LMC update on reverse referendum to increase property tax, and limit the fees that cities can charge for planning and zoning costs. 31 Page 3/13/17 ITEM 3.2A Utility Manager Neidermeier said the East and West Wastewater facilities received a Compliance Award for 2016. 12.
