RESOLUTION NO. 2017-38
RESOLUTION APPROVING DEVELOPERS AGREEMENT- ARBOR
CREEK 5TH ADDITION
WHEREAS, Centra Homes, Inc. is seeking approval of a Developers Agreement
for a portion of that already approved Plat of ARBOR CREEK 5TH ADDITION
as well as construction within Phase 5 of ARBOR CREEK 3RD ADDITION; and
WHEREAS, the approved Plat and already platted areas require construction of
public improvements and payment of City costs and fees; and
WHEREAS, those obligations are contained in the attached Developers
Agreement; and
WHEREAS, the Developers Agreement also sets forth the security required to
assure satisfactory construction of public improvements and establishes the
various remedies available to the City in the event that Developer breaches the
terms and conditions of the Agreement.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of
Otsego, Wright County, Minnesota as follows;
1. The attached Developers Agreement between the City of Otsego and Centra
Homes, Inc. is hereby approved, subject to staff approved additions and
modifications.
2. The Mayor and City Clerk are hereby authorized to execute the Developers
Agreement on behalf of the City of Otsego.
ADOPTED this 24th day of April, 2017 by the City Council of Otsego.
