awarding the contract until after the appeal period has expired. The resolution awarding the contract
could be considered at the August 12 th 2013 Council meeting.

As per council direction, the City obtained bids on June 3 . An Assessment Hearing is being held
tonight, June Z4`" to determine if the project will be awarded and to set the assessment amount. The
City has an appraiser determining an appropriate offer for tile purchase of a portion of Mr. Slavik's land
for the purpose of constructing a cul-de-sac at the southern end of the project. Drainage and utility
easements will need to be obtained for most properties in order to replace driveway culverts and
provide proper drainage. The regrading of the ditch is necessary to minimize future frost boil issues with
the street. Since this portion of the work is not assessed and is to be paid for from the Otsego Creek
fund we are asking residents to provide the required easements at no cost.
Using bid prices and an estimate for M: SlavKs land, the 50% street assessment annount per parcel
would exceed the amount noticed to each land owner in their individual notice. The amount noticed
was $4,433.7S and the 50%arnount is estimated to be $5,033.72. Our recommendation would be to
use the collector street access fund, as the removal of75mStreet access to CSAH 19 and changing it to a
cul-de-sac and the 77'h Street (CSAH 19) intersection improvements both could be considered collector

street Thenemova1of75 Street access provides proper spacing onto C5AH1Oand the
improvernent to 771h Street (C AIS 19) intersection improves 77" Street which acts as a minor collector
for the area. The cost of the two collector improvement portions of the project would combine to be at
least $9.,600. $9..600 is the difference between the assessment roll and the actual bid for the street
construction portion of the project.

RESOLUTION NO. 2013-34
RESOLUTION ADOPTING ASSESSMENT
WHEREAS, pursuant to proper notice duly given as required by law, the council
has met. and heard and passed upon all objections to the proposed assessment for the
improvement of LaBeaux Avenue Improvements.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
OTSEGO, MINNESOTA:
1. Such proposed assessment, a copy of which is attached hereto and made a part
hereof, is hereby accepted and shall constitute the special assessment against the
lands named therein, and each tract of land therein included in hereby found to be
benefited by the proposed improvement in the amount of the assessment levied against
it.
2. Such assessment shall be payable in equal annual installments extending over a
period of -years, the first of the installments to be payable on or before the first
Monday in January, 2014 shall bear interest at the rate of - percent per annurn from
the date of the adoption of this assessment resolution. To the first installment shall be
added interest on the entire assessment from the date of this resolution until December
311 2013. To each subsequent installment when due shall be added interest for one
year on all unpaid installments.
3. The owner of any property so assessed may, at any filme prior to certifications of the
assessment to the county auditor, pay the whole of the assessment on such property,
with interest accrued to the date of payment, to the city clerk, except that no interest
shall be charged if the entire assessment is paid within 30 days from the adoption of this
resolution; and the owner may, at any time thereafter, pay to the city clerk the entire
amount of the assessment remaining unpaid, with interest accrued to December 31 of
the year in which such payment is made. Such payment must be made before
November 15 or interest will be charged through December 31 of the next succeeding
year.
4. The clerk shall forthwith transmit a certified duplicate of this assessment to the
county auditor to be extended on the property tax lists of the county. Such
assessments shall be collected and paid over in the same manner as other municipal
taxes.

WHEREAS, pursuant to an advertisement for bids for the construction of City of
Otsego, LaBeaux Avenue Improvements, bids were received, opened and tabulated
according to law, and the following bids were received complying with the
advertisement:

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF OTSEGO
MINNESOTA. -
1. The mayor and clerk are hereby authorized and directed to enter into a
contract with Fehn Companies of Albertville, Minnesota in the name of the City of
Otsego for the LaBeaux Avenue Improvements, according to the plans and
specifications therefore approved by the city council and on file in the office of the City
Clerk.
2. The City Clerk is hereby authorized and directed to return forthwith to all
bidders the bid bond made with their bids, except that the bid bond of the successful
bidder and the next lowest bidder shall be retained until a contract has been signed.
