ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No No BACKGROUND/JUSTIFICATION: Use of firearms within the City is regulated by Chapter 5, Section 2 of the City Code. Section 5-2-3 of the City Code establishes a No Discharge Zone where use of firearms is limited to very specific circumstances to protect public safety. Section 5-2-4.E of the City Code further designates the area within 500 feet of collector and arterial streets as being within the No Discharge Zone. This section of the City Code must be updated to include the new designations of CSAH 38 and CR 137. Areas included in the No Discharge Zone are designated by adoption of a map in accordance with Section 5-2-7 of the City Code. The map carries over from year-to-year unless an updated map is approved by the City Council by September 1. City staff is proposing updating the No Discharge Zone Map to include recently approved developments, including Prairie View Elementary -Middle School. THE CITY COUNCIL OF THE CITY OF OTSEGO DOES HEREBY ORDAIN: Section 1. Section 5-2-4.E of the City Code is hereby repealed and subsequent sections renumber accordingly: E. By any person using projectiles (other than archery equipment) for target practice or hunting provided that the discharge occurs at least five hundred (500) feet from property lines abutting an arterial or collector street designated by the Comprehensive Plan including, but not limited to, the following roadways: 1. Interstate 94. 2. Trunk Highway 101. 3. CSAH 39. 4. CSAH 42. 5. CSAH 38 66. CSAH 37. 67. CSAH 36. 7-8. CSAH 19. 9. CR 137. 610. Odean Avenue north of 70th Street (CSAH 37). -911. Mason Avenue between CSAH 39 and 83rd Street. 4012. 83rd Street between Mason Avenue and Marlowe Avenue. 1 4413. Marlowe Avenue between 83d Street and 80th Street. 4-214. 80th Street between CSAH 19 and Marlowe Avenue. Section 2. This Ordinance shall become effective immediately upon its passage and publication. Stockamp, Mayor RESOLUTION NO.: 2017 - 66 CITY OF OTSEGO COUNTY OF WRIGHT, MINNESOTA A RESOLUTION MODIFIYING THE FIREARMS NO DISCHARGE MAP. WHEREAS, the City of Otsego has adopted Chapter 5, Section 2 of the City Code regulating the use of firearms within the City; and, WHEREAS, Section 5-2-7 of the City Code provides for designation of a No Discharge Zone within the City where use of firearms is not allowed in accordance with Section 5-2-3 of the City Code; and, WHEREAS, the No Discharge Zone Map is established by approval of the City Council and published prior to September 1; and, WHEREAS, the approved No Discharge Map remains in effect unless modifications are approved by the City Council and published by September 1; and, WHEREAS, circumstances related to land use and development within the City have changed since the current No Discharge Map was approved on 3 October 2013,- and, 013;and, WHEREAS, the City finds it is necessary to modify the No Discharge Zone Map to address these changes in land use and development so as to continue to protect public health, safety, and welfare; and, WHEREAS, the proposed modified No Discharge Map is incorporated herein as Exhibit A; and, WHEREAS, the Request for Council Action dated 14 August 2017 prepared by the City Planner, The Planning Company LLC, is incorporated herein. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Otsego that Otsego that the No Discharge Map shall be adopted as provided for by Exhibit A incorporated herein, and shall be in full force and effect upon publication in the Official City Newspaper and on the City website.
