No Yes BACKG RO UN D/J USTI FICATION: The City is proposing constructing an outlet pipe for the DNR Pond 86-7W (Praught Pond) to DNR Pond 86- 8P to provide an outlet and flood relief for the virtually landlocked upstream pond. Plans and permits have been prepared as ordered by the City Council. Staff received a letter from the DNR dated August 8th, 2017 which stated that they are "changing the permit use from Erosion /Flood Prevention to a Water Level Control Structure type of permit. With this designation change also comes some additional requirements for us to process this permit." One of those requirements is that the "City hold a public hearing on the proposal and provides the transcript of the proceedings to the department. Provisions of a transcript may be waived by the department." (Minnesota Rules 6115.0221, Subp.4.D) All landowners surrounding the three affected DNR Ponds have been mailed notices of this Public Hearing and the Hearing was posted on the City's Website. The purpose of this meeting is to provide those surrounding landowners with information, receive comments from these landowners, and to address the potential impacts that may warrant further investigation before the project is commenced.
